Wyoming UM Statutory Update, External Review Request Period Extended

December 16, 2015

As of July 1, 2015, HB0057 in Wyoming extends the time to request an external review from 60 days to 120 days within receipt of the notice of claim denial following the completion of an internal review. In addition, the law now requires the independent review organization to forward any documentation it receives from an insurer or claimant to the opposing party within one business day.

Most importantly, the bill extends these requirements to any insurance policy that provides for claim settlement for services provided by a health care provider that uses “medical necessity” or similar language.

The Wyoming Department of Insurance is also currently in the process of promulgating changes to rules in Chapter 63 (http://doi.wyo.gov/legal).
